1.1. These Terms and Conditions are for using the website (www.vivafunders.com) and the services provided by Viva Funders (“Viva Funders,” “we,” or “our”). By using the website and our services, you agree to these Terms and Conditions.

1.2. You should read these Terms and Conditions carefully before using the website or our services. If you don’t agree with these terms, you should stop using the website immediately.

1.3. These rules apply to both current and potential users of our website. When we say “you” or “user,” we mean anyone using or thinking about using our website. When we say “we” or “us,” we mean Viva Funders. The term “Service” includes all the services we provide. “Parties” refers to both users and us, or it can refer to just one of us.

1.4. We might change these Terms and Conditions from time to time, and the changes will be effective when we publish them on our website. Any additional terms or guidelines related to specific services or information on the website will also be considered part of these Terms and Conditions.

Age Requirement

2.1. This platform is only for individuals aged 18 and older. By agreeing to these terms and using our service, you confirm that you are legally allowed to access and use the online platform.

2.2. The age requirement mentioned here may vary in application contingent upon the jurisdiction and might differ depending on where you are. By using this platform and our service, you promise to follow the legal age requirements in your jurisdiction or country to form a binding contract and meet any other eligibility criteria.

Unauthorized Access:

3.1. Trying to access this platform, its servers, or any connected computer systems unlawfully is against the law. This includes launching denial-of-service attacks. Breaking this rule is a criminal offense and will result in immediate loss of access to the platform. Any such incidents will be reported to the appropriate law enforcement agencies.

3.2. We are not responsible for any damage caused by denial-of-service attacks, viruses, or other harmful technology that may affect your computer equipment, programs, data, or other resources while using our platform or downloading materials from it or any linked websites.

Provision of Services and Operational Protocol:

4.1. Our online platform, www.vivafunders.com, provided by Viva Funders, offers tools for simulating foreign exchange transactions in the FOREX market and transactions with alternative instruments in various financial markets.

4.2. Our services and platform are solely for simulated trading, not live trading. Viva Funders explicitly states that it does not support live trading activities. Therefore, any attempt to engage in live trading through our platform is strictly prohibited, and to be honest, live trading is not even possible through Viva Funders.

4.3. Quotations for our services related to FX, Metals, Commodities, Shares, and Indices are available 24/5. For CRYPTO, quoting is continuous 24/7. While it’s possible to hold positions over the weekend, pricing isn’t provided during that time. As a result, no opening, closing, or modification of positions is possible from market close on Friday until market reopening on Sunday.

Viva Funders Account

5.1. Once you purchase a trading challenge, we’ll provide you with credentials to access the Viva Funders Account, as well as the credentials for the Trading Platform (cTrader).

5.2. You’ll get access to both your Viva Funders Account and the Trading Platform using login details provided by us through your client dashboard or email.

5.3. Sharing your login details with anyone else is not allowed. You’re responsible for keeping your login credentials and Viva Funders Account safe. If there’s any misuse of your account or the Trading Platform beyond our control, we’re not responsible, and you won’t be compensated.

5.4. Using the Trading Platform means you agree to the terms, conditions, and privacy policy of the provider.

5.5. You’re responsible for making sure the information you provide to Viva Funders is accurate, complete, and up-to-date. If there are any changes to your information, you need to let us know promptly via your registered email address. We’re not obligated to verify the accuracy of your information.

5.6. Sometimes, the Viva Funders Account and Services might be unavailable due to maintenance, technical issues, or other reasons beyond our control. We’re not responsible for any temporary unavailability, data loss, or changes made to your account by us in response to your requests.

5.7. We’re not obligated to provide automatic compensation for any issues. Any compensation decisions are at our discretion, within the limits of liability.

5.8. To use our Services, you’ll need the right technical equipment (like a smartphone or computer) and software, including any necessary third-party software for the Trading Platform. You’re responsible for any risks or expenses related to this.

5.9. We don’t guarantee that our Services will work with any specific equipment or software. We don’t offer warranties about compatibility with any device, program, or add-on.

General Trading Rules:

6.1. At Viva Funders, we believe in responsible trading and reward traders who demonstrate skill in their activities. We strongly discourage any attempts to manipulate the system or engage in speculative trading practices. To ensure this, we’ve established a Responsible Trading Policy that all traders must follow.

6.2. Traders must adhere to the following General Trading Rules.

Prohibited actions include:
(a) Using prohibited trading strategies exploiting service errors.
(b) Executing trades using external or slow data feeds.
(c) Engaging in solitary or collusive trading activities.
(d) Using “challenge passing” services or multiple IP addresses.
(e) Violating the Terms and Conditions of the Provider or Trading Platform.
(f) Using software or strategies that provide unfair advantages.
(g) Participating in trades that go against established financial market practices or harm Viva Funders financially.

6.3. Traders must follow Risk Management Rules:
(a) We monitor each account for signs of speculative or reckless trading to safeguard our capital and promote trader success.
(b) If a trader exhibits reckless behavior, we reserve the right to take appropriate actions.

6.4. Traders must also adhere to Automated Trading Rules:
(a) Using MQL5 or cTrader signal services or directly replicating trades from another Viva Funders Trader is strictly prohibited.

6.5. Violation of any rules in this section may result in the immediate termination of the account without a refund.

6.6. If a trader, in collaboration with another Viva Funders Trader, violates any rules, all involved accounts will be terminated without a refund.

6.7. We reserve the right to terminate any accounts where there is reasonable suspicion of wrongdoing, without issuing a refund.

6.8 Restricted Trading Strategies at Viva Funders:

• Prohibited Practices: Strictly no cheating or exploitation.
• Abuse of System: Trading styles must reflect real market conditions.
• HFT: High-Frequency Trading or e-trading protocols not allowed due to market manipulation risks.
• Latency Trading: Exploiting trade execution delays is unethical and banned.
• Copy Trading: Only allowed between accounts owned by the same individual.
• Hedging: Hedging across multiple accounts not allowed.
• Arbitrage Trading: Any form of arbitrage trading strictly prohibited.
• Tick Scalping: Limited due to potential market manipulation.
• Grid Trading: Prohibited due to market instability and risk.
• One-sided Betting: Restricted due to speculative nature and potential losses.
• Account Sharing: Sharing or reselling accounts is strictly forbidden.
• Hyperactivity: Excessive trading activity is monitored and restricted.
• Platform Abuse: Any use of platform or data freezing for unfair advantage is prohibited.
• Limit Order Guarantees: Implementation of guaranteed adherence to limit orders not allowed.

Challenge and Verification Accounts Overview:

7.1 Fees:
Accounts are in USD with fixed sizes and fees, billed in the chosen currency. Fees are non-refundable.

7.2 Rules:
(a) Max Drawdown Rule: Account equity must not fall to or below 8% of the account equity.
(b) To qualify, the trader needs to have a minimum of 10 days of trading on their live account and must have completed 30 calendar days after the first open trade without any rule violations.
(c) Responsible Trading Policy: Traders must adhere to rules, covering General Trading, Risk Management, and Automated Trading. Violations may lead to account termination. Viva Funders reserves the right to change rules at any time.

7.3. Targets:
(a) Profit Target: To complete evaluation challenge, achieve 10% profit of initial account capital without rule violations of any kind.

7.4 Withdrawing Profits:
To qualify, meet conditions without any rule violations. Withdrawals can be requested 30 days after the first trade.

Payments

8.1. Currency and Payment:
Users can make payments in their selected currency. If a non-website currency is used, payment is subject to the prevailing market exchange rate at the time of the transaction.

8.2. Payment Methods:
Payment can be made using credit/debit cards, cryptocurrency or other selected payment method available.

8.3. Information Security:
During the payment process, users may need to provide relevant information, including personal details and payment information.

8.4. Tax Responsibilities:
Service charges do not cover all taxes. Legal entities or traders are responsible for fulfilling all tax obligations related to their use of our services.

8.5. Security Measures:
In compliance with anti-illegal activity measures, third-party payments are not accepted. Payment method details must align with the Know Your Customer (KYC) and withdrawal information provided for the protection of our services against unauthorized activities.

Disclosure of Risks:

All content provided by Viva Funders and its associated entities (referred to as the “Company”) is intended solely for educational purposes related to trading on financial markets. It should not be construed as specific investment recommendations, business advice, investment opportunity analyses, or general trading recommendations. Trading in financial markets carries inherent risks, and it is strongly advised not to risk more than one can afford to lose.

Viva Funders does not offer any of the investment services outlined in the Capital Market Undertakings Act No. 256/2004 Coll. The information presented in this document is not directed at residents in any country or jurisdiction where such distribution or use would contravene local laws or regulations. Viva Funders is not a broker and does not accept deposits. Viva Funders or its broker partners reserve the right to:

• Adjust margin requirements at any time based on perceived or actual excessive changes in volatility and/or liquidity.
• Cancel orders or trades at any time based on the perceived or actual risk of non-execution of stop or limit orders due to market conditions.

Neither Viva Funders nor its broker partners assume responsibility for variable spread, liquidity levels, or limit order execution parameters provided by liquidity providers and market makers.

Approval:

By using Viva Funders services, the user acknowledges that they have read, understood, and agreed to the evaluation terms and rules outlined in this document, as well as the Detailed Explanation of Evaluation rules and objectives available on www.vivafunders.com.

No provision of this Agreement may be waived or amended unless the waiver or amendment is in writing and signed by the user and an authorized officer of the Company. This Agreement shall be subject to the laws of the UAE.

This agreement can also be digitally approved and signed by all parties in the Viva Funders Client Section. The user has digitally approved this agreement on app.vivafunders.com.
